Storm Water Credit Policy

Eligibility

The purpose of this Stormwater Utility Credit Policy is to encourage actions by property owners that reduce peak discharge rates and improve storm water quality. Credits approved by the Village will be applied to the storm water utility bill for as long as the property owner maintains their credit eligibility. Credits will be considered if the property owner:

  1. Installs, operates and maintains storm water practices that provide measurable, maintainable reductions in peak discharge rates, or
  2. Installs, operates and maintains storm water practices that provide measurable, maintainable improvements to storm water

One and two family residential properties are not eligible for credits under this policy because of the typically immeasurable benefits of small residential Best Management Practices (BMP) and the relatively high cost of administering credits for such BMPs.

The total maximum allowable storm water utility credit is 50% of the annual Equivalent Runoff Unit (ERU) charge for a parcel or property.

Peak Discharge Credit

The maximum allowable peak discharge credit is 20% for a parcel or property. The peak discharge credits will be determined based on the following criteria:

  1. Post-development peak discharge rates for the 1, 2, 10, and 100-year, 24-hour design storm events shall be reduced for the parcel or property. The peak discharge credit will be determined after the percent reduction in post­ development peak discharge rate is calculated by the applicant for the 1, 2, 10, and 100-year, 24-hour design storm The smallest percent reduction for the four design storm events and the following table will be used by the Village to establish the peak discharge credit. The peak discharge credits in the following table are not additive or cumulative.

Storm Water Quality Credit

The maximum allowable storm water quality credit is 30% for a parcel or property. The storm water quality credit will be determined based on the following criteria:

  1. Total suspended solids (TSS) shall be reduced for the parcel or property. TSS is used as a surrogate for other storm water pollutants. The storm water quality credit will be determined after the percent reduction is calculated by the applicant using procedures, guidance and technical standards identified in the Village's Storm Water Management Ordinance. The following table will be used by the Village to establish the storm water quality credit. The storm water quality credits in the following table are not additive or cumulative.

Credit Application

  1. Property owners shall submit a credit application to the Village, including the necessary information on the attached form and the following:

Owner Certification

  1. The property owner shall provide written certification to the Village that the BMPs or practices associated with the credit application are installed, operated and maintained in accordance with the Operation & Maintenance Plan and supporting
  2. The applicant shall provide "record drawings" and written certification that the peak discharge practice(s) are functioning in the manner indicated on the credit
  3. The applicant shall provide "record drawings" and a written certification that the storm water quality practice(s) are functioning in the manner indicated on the credit 

Operations & Maintenance Plan

  1. The applicant shall provide a written plan or manual for the operation, inspection, and maintenance of all peak discharge and storm water quality practices.
  2. The applicant shall enter into an Operation & Maintenance Agreement with the Village for the BMPs and practices and have this agreement recorded at the Brown County Register of Deeds office

Supporting Documents

  1. The applicant shall provide hydrologic and hydraulic calculations, storm water quality calculations, maps, reports, plans, and other supporting documentation to the Village that demonstrates the BMPs or other practices meet the requirements of this credit A Professional Engineer or Hydrologist, licensed in the State of Wisconsin, shall certify the calculations, maps, reports, plans and other supporting documentation meet the requirements of this credit policy.

  2. The Village Engineer (or designee) shall review storm water  utility  credit applications for compliance with this policy. The Village Engineer (or designee) shall have thirty (30) calendar days to review credit applications, whereupon the Village Engineer may approve or deny the application as submitted, or provide  comments for re-submittal. In the event of a re-submittal request, the thirty-day period  referred to above shall begin again pending the receipt of all information requested.

  3. Credit appeals are made to the Village Board.
